By creating an account, accessing, or using TavernMind (the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years old to use TavernMind. If you are under 18, you must have your parent or guardian's permission to use the Service. By using TavernMind, you represent and warrant that you meet these eligibility requirements.
To access certain features of TavernMind, you must create an account. You agree to:
TavernMind offers three subscription tiers:
Pricing is subject to change with 30 days' notice. Subscription fees are billed monthly and are non-refundable except as required by law.
You may cancel your Hero Premium subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.
No Prorated Refunds: We do not offer prorated refunds for partial months. If you cancel mid-cycle, you will not receive a refund for the remaining days, but will retain premium access until the billing period ends.
Free Tier Access: After cancellation, your account will automatically revert to the Free Wanderer tier. Your characters and campaign progress will be preserved, but multiplayer and unlimited turns will no longer be available.
Refund Requests: Refunds are only provided in cases of billing errors or as required by applicable law. To request a refund, contact us at tavernmind@polsia.app within 7 days of the charge.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe:
You may delete your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease, and we may delete your characters, campaigns, and account data.
All content included in TavernMind—including text, graphics, logos, software, campaign narratives, quest designs, item descriptions, and the AI Dungeon Master's responses—is the property of TavernMind or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of content you create through TavernMind (characters, campaign decisions, party names). By using the Service, you grant us a worldwide, royalty-free license to use, display, and process your content solely to provide and improve the Service.

TavernMind is in Early Access. You acknowledge that features may be incomplete, experimental, or subject to change. We do not guarantee that campaigns, characters, or game progress will be preserved during updates.
TavernMind uses artificial intelligence to generate all narrative content, quest descriptions, NPC dialogue, item descriptions, dungeon layouts, and Dungeon Master responses. All content is AI-generated and may contain inaccuracies, inconsistencies, or unexpected outputs.
By using TavernMind, you acknowledge and agree that:
Content Moderation: While we employ content filters and safety measures, we cannot guarantee that all AI-generated content will be appropriate for all audiences. If you encounter objectionable content, please report it to tavernmind@polsia.app.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAVERNMIND SHALL NOT BE LIABLE FOR:
IN NO EVENT SHALL TAVERNMIND'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR $100, WHICHEVER IS GREATER.

TavernMind relies on third-party AI providers (including but not limited to OpenAI, Anthropic, and other language model providers) and infrastructure services (hosting, databases, content delivery networks) to deliver the Service. We are not responsible for the performance, availability, or actions of these third-party services.
By using TavernMind, you acknowledge and agree that:
No Warranty for Third-Party Services: We make no representations or warranties regarding third-party services and disclaim all liability for their performance or availability.
TavernMind shall not be liable for any failure to perform or delay in performance of its obligations under these Terms due to events beyond its reasonable control, including but not limited to:
During force majeure events, TavernMind's obligations shall be suspended for the duration of the event. We will make reasonable efforts to notify users of significant service disruptions and provide updates when possible.
You agree to indemnify, defend, and hold harmless TavernMind, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service or violation of these Terms.
We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for issues relating to intellectual property rights or unauthorized access to the Service.
YOU AND TAVERNMIND AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION OR PROCEEDING.
Unless both you and TavernMind agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class, representative, or collective proceeding. You and TavernMind each waive any right to participate in:
Severability: If any part of this Class Action Waiver is found to be invalid or unenforceable, the remainder of these Terms shall remain in full force and effect. However, if the Class Action Waiver is found to be unenforceable with respect to a particular claim or request for relief, then that claim or request for relief shall be severed and brought in court, while all other claims proceed in arbitration.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TavernMind regarding the Service.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
